Brazilian Justice orders Google to compensate woman exposed on Street View

Google has been ordered to compensate a woman whose image was published on Google Maps’ Street View feature without her authorization.

The decision by the São Paulo State Court of Justice (TJSP), published last Friday (29), set the compensation at R$ 15,000, equivalent to $3,000, for moral damages.

According to the case details, the 61-year-old woman was photographed at the house where she worked as a cleaner in the capital city of São Paulo. This means that when searching for the address in question, a partial image of her face could be seen.

The woman contacted Google on two occasions to request the removal of her image from the platform but received no response. Her image was only blurred after she sought legal action and obtained interim relief.

According to the TJSP judges, the woman did not authorize the use of her image by the technology giant, which constitutes a violation of her rights. Furthermore, there was cited an “offense to the right to personal identity” due to the association of the woman’s image with the location of the property where she worked.

“In this case, the defendant, although acting to help locate addresses and facilitate the lives of those seeking access to places, is not immune to the point of receiving amnesty for allowing its reproductions to come out with an image that made it possible to recognize and identify the author,” observed Judge Enio Zuliani. So far, Google has not commented on the case.
